Terms of Service

1. Acceptance

By accessing catchallorders.com or using the Catch All Orders service, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Service description

Catch All Orders is a missed call text-back system for restaurants. When a customer call goes unanswered, we detect the missed call and send an automated SMS on behalf of your restaurant, including your menu and order link. The service requires a compatible phone system and initial setup.

3. Founding member terms

Founding member spots are offered at no monthly software fee. Founding members pay only carrier SMS costs (approximately $0.01 per outbound text). Catch All Orders reserves the right to introduce standard pricing after the founding period with 30 days written notice.

4. Acceptable use

You agree to use the service only to send legitimate business communications to customers who have called your restaurant. You may not use Catch All Orders to send unsolicited messages, marketing to contacts who have not called, or any communications that violate the TCPA or CAN-SPAM Act.

5. SMS messaging terms

Catch All Orders sends text messages as part of the service. Recipients consent to receive these messages by providing a mobile number or by calling a restaurant that uses Catch All Orders. Message types include demo scheduling, order confirmations, service updates, and automated replies to missed calls.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. We honor STOP requests promptly and send a single confirmation.

Restaurants using Catch All Orders are responsible for obtaining any consent required by the TCPA and applicable law before messaging their customers, and for honoring opt-out requests. Catch All Orders does not sell or share SMS opt-in or consent information with third parties for marketing purposes.

6. Limitation of liability

Catch All Orders is not liable for missed call detection failures, SMS delivery failures, carrier delays, or lost orders resulting from system downtime. Our liability is limited to fees paid in the 30 days prior to any claim.

7. Termination

Either party may terminate service with 14 days written notice. Upon termination, your restaurant's data will be deleted within 30 days.

8. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict of law provisions.
